Payment Terms:  The Client understands that The Chocolate Aristocrat agrees to hold a reservation for the
Client’s Event. Confirmation of this agreement must be made by Client by returning the signed proposal and
remitting the balance due. The balance due can be paid by company check or credit card. (Please make
checks payable to The Chocolate Aristocrat and remit to: 11152 Westheimer Rd. # 662 Houston, Texas
77042)  All catered functions must have a secured payment before the event date or we will be unable to
service your event.

Cancellations:  All cancellations should be called into our office as soon as possible. Refunds on
cancellations due to extenuating circumstances will be considered on an individual basis and are made at
The Chocolate Aristocrat’s sole discretion. The Chocolate Aristocrat does not accept any liability for non-
completion of the event or for delays resulting from adverse weather conditions, traffic accident or road closure,
fire, flood or other natural disaster, or for any other event which is beyond The Chocolate Aristocrat’s Control.  

Attendance: The guest count the Client specifies in the Proposal is the guaranteed guest count. If attendance
is more than the guest count specified by the Client we will make every effort to accommodate your group.
However, we cannot guarantee availability of items as specified in the original proposal.  

Leftover Policy: Once the event has concluded, all remaining food items (with the exception of cakes, cookies,
brownies and trayed baked goods), unopened products and paper goods are the property of The Chocolate
Aristocrat. No credit will be issued for leftover food or unused items. All food must be consumed after 2 hours
of initial serving; therefore any food consumed after 2 or more hours of it first being served is at the client’s
discretion and becomes their responsibility.

Equipment:  All catering equipment utilized at an event site must remain at its location before, during and after
an event.  The equipment must not be removed from its location unless prior approval has been received from
The Chocolate Aristocrat.  Catering equipment is provided on loan, and any missing, damaged or altered
equipment will result in a corresponding replacement charge added to your invoice.

Rentals:  If tables and linens are required, they are an additional cost that will be included in your proposal.  
Sufficient notice is required to secure these items and all rentals are subject to market availability.

Liability:  The Chocolate Aristocrat and/or its agents shall be liable for any damage to or loss of property
entrusted to its employee’s. Client shall be liable for any injury, damage to or loss of property that is caused by
the Client or guests of the Client. Due to liability reasons, only staff members of The Chocolate Aristocrat will
be allowed in Food Preparation areas, Serving Stations and Catering Vehicles.

Provisions:  The Client understands that The Chocolate Aristocrat may require access to the set-up area at
least one full day prior to the event, as well as after it’s conclusion for clean-up and removal of equipment. The
client is responsible for providing electrical outlets that adhere to safety standards. Client is also responsible
for providing sturdy, level tables capable of supporting 150 lbs. and trash receptacles in the vicinity for the
guests. Client accepts full responsibility for any damages incurred or delays that occur as a failure to comply
with these provisions.
